The
state regulation (17 CCR 6523(e)) granting the Prenatal Screening (PNS) Program
exclusivity for its screening panel is currently not in effect due to a
preliminary injunction issued November 2, 2022.
This ruling means that labs that have not contracted with the PNS Program are currently able to screen for trisomy 13, trisomy 18, trisomy 21 and neural tube defects (NTDs) outside of the Program. State regulations still require clinicians to share information on the PNS Program with pregnant individuals.
The PNS Program makes comprehensive prenatal screening available for $232 (trisomies 13/18/21) and $85 (NTDs). Genetic counseling and diagnostic testing for individuals found to be at high risk are included in these fees.
