Senate Bill 1312 Chapter 895 Statutes of 2006



ā€‹This AFL provides long-term care facilities with statutory requirements mandated by SB 1312 chapter 895 statutes of 2006, signed into law on September 30, 2006. This notice includes only those requirements of the legislation specific to long-term care facilities.

Effective July 1, 2007, the law requires the newly established Department of Public Health (DPH) to begin conducting unannounced periodic licensing inspections for all long-term care facilities licensed by the Licensing and Certification Program of DPH. Prior to beginning the licensing surveys, DPH must identify all state law standards for the staffing and operation of long-term health care facilities.

The state licensing surveys will be conducted annually. Those facilities that have not had a class AA, A, or B violation within 12 months of the last survey will receive an inspection every two years.

To the extent that the scheduling for mandated timeframes within which DPH must adhere to when conducting federal certification and state licensing inspections do not conflict, federal certification and state licensing surveys shall be conducted concurrently.
